The Court of Appeal, Abuja yesterday threw out an appeal seeking to stop hearing of the federal government case on the controversial $15m James Ibori bribe money.
Justice Amiru Sanusi leading two other justices struck out the motion for being defective and grossly incompetent to be heard.
A Lagos based refrigerator repairer Olalekan Bayode had filed the motion in which he prayed that the federal government suit on the ownership tussle on the money be stopped pending the final determination of his appeal case at the Abuja division of the Court of Appeal.
The grouse of the Appeal Court was that the motion did not contain the grounds upon which it was filed by a United Kingdom based lawyer Mr John Kayode Olufemi Aina.
The applicant in the motion, Olalekan Bayode had at the Federal High Court applied that he be appointed as a manager to disburse the $15m bribe money to the indigents, especially widows and orphans through a charitable organization.
